Waste Management Rules in India: What Generators and Producers Must Do

India regulates waste through separate rule sets for hazardous, plastic, electronic, bio-medical, construction and municipal solid waste. Most organisations are caught by more than one, and the duties differ depending on whether you are a generator, a producer or a brand owner.

Hazardous and Other Wastes Rules

Any unit generating waste listed in the schedules — spent oil, used chemicals, contaminated packaging, ETP sludge, paint residues — needs authorisation from the State Pollution Control Board and must send waste only to authorised recyclers, co-processors or TSDF operators.

Records are kept in prescribed forms and an annual return is filed. Manifests must accompany every consignment.

Plastic Waste Management Rules and EPR

Producers, importers and brand owners of plastic packaging register on the CPCB EPR portal and carry annual collection and recycling targets, discharged by procuring certificates from registered recyclers.

Targets escalate over time and are category-specific across rigid, flexible, multilayered and compostable packaging.

E-Waste Management Rules

Producers of electrical and electronic equipment listed in the schedule register for EPR and meet collection targets calculated on past sales and average product life. Bulk consumers must channel end-of-life equipment to registered recyclers and maintain records.

Bio-Medical Waste Rules

Healthcare facilities require authorisation, segregate waste into colour-coded categories at source, use barcoded bags, hand over to a common treatment facility, and file annual returns. Training records and immunisation records for handlers are routinely inspected.

Construction, demolition and municipal solid waste

Large generators of construction and demolition waste must submit a waste management plan and use authorised processing facilities. Bulk waste generators of municipal solid waste — large campuses, apartment complexes and commercial buildings — are required to segregate and, in many cases, process wet waste on site.

Building a system rather than filing forms

Compliance across these rules depends on three practical things: segregation that actually happens at source, a documented and verified disposal chain, and records that reconcile quantity generated with quantity dispatched. Where those three hold, returns become a reporting exercise rather than a reconstruction exercise.

Missed returns are treated as non-compliance with the authorisation conditions and can trigger show-cause proceedings and affect renewal, apart from the statutory consequences under the parent Act.
